General Terms and Conditions for the HVAC Lift Webshop

These general terms and conditions apply to all agreements, offers, deliveries and services of the HVAC Lift webshop. By using our webshop, placing an order or concluding an agreement, you agree to the conditions below.

1. Definitions
In these terms and conditions the following terms shall have the following meanings:

  • Customer : the person or legal entity that purchases products or uses a service via the webshop.
  • Webshop : the online store of HVAC Lift where products are offered.
  • Products : the goods offered through the webshop.
  • Agreement : an agreement between HVAC Lift and the customer, arising from an order.

2. Applicability
These general terms and conditions apply to all agreements that are concluded via the webshop of HVAC Lift, as well as to all offers and deliveries of HVAC Lift. By placing an order you agree to these conditions.

3. Offer and Prices
3.1 All products in the webshop are without obligation and subject to availability.
3.2 The prices of the products are clearly indicated on the website and are inclusive of VAT, unless stated otherwise.
3.3 Shipping costs will be indicated separately at checkout and are the responsibility of the customer, unless stated otherwise.

4. Orders and Agreements
4.1 An order is placed by the customer via the order form in the webshop.
4.2 The agreement is concluded at the moment that HVAC Lift has confirmed the customer's order by e-mail or other means of communication.
4.3 HVAC Lift reserves the right to refuse or cancel orders, for example in the event of incorrect information or payment problems.

5. Payment
5.1 Payment must be made using the payment methods indicated on the website.
5.2 All payments must be made in full before the order is shipped, unless otherwise agreed.

6. Delivery
6.1 The delivery of products will take place at the address specified by the customer, within the agreed period.
6.2 Delivery times are indicative and HVAC Lift is not liable for delays beyond its control.
6.3 The risk of loss or damage to the products passes to the customer at the time of delivery.

7. Right of withdrawal
7.1 The customer has the right to revoke the agreement within 14 days after receipt of the products without giving any reason.
7.2 To exercise the right of withdrawal, the customer must inform HVAC Lift within the stated period.
7.3 The customer is responsible for the costs of return shipping, unless otherwise agreed.

8. Warranty and Complaints
8.1 HVAC Lift provides a warranty on the products that meets the legal requirements.
8.2 Complaints about the delivered products must be submitted in writing or by e-mail as soon as possible after receipt, but no later than 14 days.
8.3 If a product is defective, HVAC Lift will, at its discretion, replace the product or refund the purchase price.

9. Liability
9.1 HVAC Lift is not liable for damage resulting from the use of the delivered products, unless there is intent or gross negligence on the part of HVAC Lift.
9.2 HVAC Lift's liability is in all cases limited to the amount paid by the customer for the product that gave rise to the damage.

10. Intellectual Property Rights
10.1 All intellectual property rights relating to the products and the content of the webshop (such as text, images, logos, software, etc.) remain at all times the property of HVAC Lift or its licensors.
10.2 The customer is prohibited from reproducing, distributing or otherwise using products or content from the webshop for commercial purposes without permission from HVAC Lift.

11. Privacy
11.1 HVAC Lift respects the privacy of its customers and acts in accordance with applicable privacy legislation.
11.2 The personal data provided by the customer will only be used to process orders and improve the webshop experience. For more information, please refer to the privacy policy of HVAC Lift.

12. Force Majeure
12.1 HVAC Lift shall not be liable for delays or failure to fulfil its obligations if this is due to force majeure, such as natural disasters, wars, strikes, illness or other unforeseen circumstances.

13. Applicable Law and Disputes
13.1 Dutch law applies to these general terms and conditions and the agreement.
13.2 Disputes will initially be submitted to the competent court in the jurisdiction where HVAC Lift is established.

14. Changes to the General Terms and Conditions
14.1 HVAC Lift reserves the right to change these general terms and conditions. Changes will come into effect at the moment they are published on the webshop.
14.2 It is the customer's responsibility to regularly consult the terms and conditions.
